The assignment for the first day is to read pages 5–39 in the casebook, and to prepare to discuss your answers to problems 1-1 and 1-4.

What is Administrative Law? Federal agencies are pervasive in everyday legal life, so understanding the American legal system requires understanding the very distinct body of law that applies to these agencies. Specifically, this course discusses the guidelines and restrictions that the law places on agency regulations, agency adjudication, and agency information-gathering; on judicial review of agency action; on the constitutional structure of agencies; and on public access to agency processes.
How is class run? Class will feature a mixture of lecture, discussion, and cold-calling. In each class, you will review hypotheticals that require you to learn and apply the doctrine. In this way, you will also get a taste of the diverse range of issues that agencies manage.
How is performance assessed? Grades will be based on a 2.5 hour, closed-book, closed-note exam, with possible minor adjustments based on unpreparedness in class.

(a) Participants: List the names and roles of the people mentioned in the Joint Appendix.
(b) Events: Create a detailed chronological timeline that covers (1) every step leading to the events of December 3, 2025; and (2) every step of what happened on December 3, including names and exact times or durations, minute-by-minute. Include citations to the Joint Appendix for each fact in the form “J.A. at 6†or “J.A. at 45-46.†Those page references will be very useful to you over the course of the semester. That reading will introduce you to the relevant law for the appellate problem we will work with all semester, which concerns whether evidence should be suppressed in a case concerning drug possession and distribution.

Oral Argument Observation and Analysis
Due March 15, 2026, at 11:30 p.m.
Advocacy focuses on both written and oral persuasion. After you write the appellate brief,
the course will culminate with an appellate oral argument. To learn more about oral
advocacy, you will be required to watch two oral arguments for this assignment:
• at least one actual court argument in-person in a courtroom and
• one argument in a moot court competition, either online or a final in-person
practice for an MSU moot-court team.
The goal of the assignment is to familiarize yourself with the process of oral argument and
to observe the differences between an actual oral argument and an oral argument in a moot
court setting.
The assignment is worth 100 points, 70 for substance and 30 for writing.
Assignment
Your analysis of the arguments should be a total of 750 to 1500 words. Please write about
the arguments in paragraph form, not in a numbered list, but address the following topics:
1. Background
• Name of the court/moot court and date of the argument
• Subject of the argument (do not summarize the entire litigation)
2. The Advocates
• The quality of the arguments advanced by each side (focus primarily on
clarity and presentation, rather than just the substance)
• The demeanor, preparedness, and professionalism of counsel
• The type of materials taken to the podium
• Counsel’s responses to questions and the effectiveness of their responses
3. The Bench
• The demeanor and professionalism of the judges
• The reception of the arguments by the bench
• The quantity and form of the questions
• The decision announced, if any

4. Procedure
• Length of the argument total and on each side
• Time warnings if any
• Appellant’s rebuttal if any
5. Differences between the actual oral argument and the moot court oral argument

Court Information
You may find it convenient to attend an appellate argument before your first Advocacy
class. The argument can be in any jurisdiction, federal or state, as long as it is in an
appellate court. Do not attend an argument at a trial court. You should attend an argument
presided over by more than one judge.
Courts’ oral argument schedules are usually available online. The schedules, including
times and courtrooms, for Michigan Court of Appeals and Michigan Supreme Court are
available on the Michigan courts’ website: courts.michigan.gov. Use the menu, and select
Michigan Supreme Court or Michigan Court of Appeals. At the home for the court selected,
look for information about case schedules. The Michigan Supreme Court sits in Lansing. It
hears cases only one or two days each month, so check its calendar well in advance. The
Michigan Court of Appeals has panels that meet in Detroit, Lansing, and Grand Rapids.
The panels hear cases on Tuesdays and Wednesdays during the first two weeks of each
month. The Court of Appeals case call panel schedule gives the times and cases for each
session.
Courtroom Etiquette
When attending a court session, please respect the following rules of etiquette:
• Dress in business or business casual attire. Do not wear a hat.
• Do not talk with others in the courtroom while the court is in session; do not bring
newspapers, magazines, or other reading material into the courtroom.
• Turn off your cell phone before entering the courtroom. Some judges may confiscate
cell phones that ring during court proceedings.
• Remain seated during arguments. Enter and exit the courtroom quietly and only
when arguments in the case have concluded.
• Remember that you may be practicing in front of these judges one day. Start
demonstrating your professionalism now.

(b) Events: Create a detailed chronological timeline that covers (1) every step leading to the events of December 3, 2025; and (2) every step of what happened on December 3, including names and exact times or durations, minute-by-minute. Include citations to the Joint Appendix for each fact in the form “J.A. at 6†or “J.A. at 45-46.†Those page references will be very useful to you over the course of the semester. I recommend using a table, like the following example:

Break reading:
In anticipation of each semester of the Immigration Law Clinic, we choose a book that we suggest our incoming students read. Some of these are books we've read that we are eager to share. This suggested reading is absolutely voluntary, sort of our version of One Book One Community, and we likely will not formally discuss the book as part of the course. We try to select works that relate to our work in the clinic and that we think will be enjoyable and relevant. These are not works that set forth substantive immigration law but rather works that provide thoughtful exploration of the cultural and practical issues that arise when working with immigrant communities.
More generally, our hope is that shared reading of a book related to our shared work is among the first steps toward building the community that we seek to cultivate in our clinic. I strongly encourage you to consider placing this semester's book on your reading list if your other time commitments so allow.
For the Spring 2026 semester, we've chosen Sonia Nazario, Enrique’s Journey: The Story of a Boy’s Dangerous Odyssey to Reunite with his Mother. This book was originally published in 2006, but it was updated in 2014. Based on a Pulitzer Prize winning series of LA Times articles, the book chronicles the journey of a boy from Honduras to the United States. As a part of your caseload, all of you will represent unaccompanied minors and this account provides some background and context for that work. Please stop by the clinic during regular hours to receive a FREE copy of the book.

What is Torts II? This course covers a grab bag of tort law not covered in most Torts I classes: nuisance, defamation, privacy, civil rights, misuse of legal procedure, misrepresentation, interference with advantageous relationships, torts in the age of statutes, and alternative compensation systems. This knowledge will allow you to determine when injured people can get a legal remedy for injuries in these contexts, and from whom. We will also discuss some of the theory and policy bases of tort law, so that you can understand why tort law is the way it is, and how it may change.
How is class run? Class will feature a mixture of lecture, discussion, and cold-calling.
How is performance assessed? Grades will be based primarily on a 2-hour, closed-book, closed-note exam. The exam will feature essay questions and multiple-choice questions.
